Do citations stay on record?
A citation does not stay on your record. A citation means that you are being “cited” for a charge. That charge, if you are convicted or you plead guilty is what stays on your record.
Are citations public record?
That being said, due to the Freedom of Information Act, enacted in 1966, traffic citations are now considered public records. Anyone is capable of applying for such information through various online resources or through their local sheriff’s department, where files upon files are stacked with this type of information.
How do you fight citations?
The law allows you to contest any traffic infraction entirely by mail. You can appear via mail through a Written Not Guilty Plea pursuant to California Vehicle Code 40519(b). In your plea you can request a Trial by Written Declaration pursuant to CVC 40902.
