When must an IEP meeting be held?

After a child is found eligible for special education and related services, a meeting must be held within 30 days to develop to the IEP. The school system must notify the child’s parents of when and where the meeting will take place, so they have the opportunity to attend and participate.

How often can I request an IEP meeting?

A parent can request one at any time. However, I recommend that if you are within 6-8 weeks of your child’s annual IEP renewal that you wait until the annual meeting. Unless of course, it’s a serious issue that needs to be addressed as soon as possible, such as any kind of safety or harm issue.

Can you amend an IEP without a meeting?

Parents often ask about amending an IEP without a meeting, and whether it is legal for the school to change their child’s Individualized Education Program without a meeting of the IEP Team. While an IEP must be developed by the IEP Team, changes to the IEP can be made without a meeting of the IEP Team.

Can parents refuse an IEP?

No. Federal regulations state that “only the parent has the authority to make educational decisions for the child … including whether the child should attend an IEP Team meeting.” If you want your child to attend, the school can’t refuse. (See the regulations in this PDF at page 46671.)

Can an IEP be changed?

Changes to the IEP may be made either by the entire IEP Team at an IEP Team meeting, or as provided in paragraph (a)(4) of this section, by amending the IEP rather than by redrafting the entire IEP. Upon request, a parent must be provided with a revised copy of the IEP with the amendments incorporated.

When should an addendum be used?

When to Use an Addendum Addenda are modifications added to an existing agreement to add or change a few of its terms and conditions. It does not replace the original contract. Use an addendum to add information agreed to after the parties have agreed on the contract terms.
