Can an atheist be an Eagle Scout?
The Supreme Court affirmed BSA’s right to exclude open agnostics or atheists from its membership in 2000. There has been at least one case in which atheists went to court to get their Eagle Scout badges after refusing to take an oath to God.

Has anyone failed an Eagle Board of Review?
I personally have never heard of a Scout failing his/her Board of Review. Of the 30 something young men I have had the honor of watching make Eagle Rank, none had failed there initial Board of Review. It may be a testament to the Troop Leaders and Scouts that came before them.
